Thanks... we countered their counter... lol... will see what happens. If this back and forth keeps up, it will get to the point where we have to walk away, because it will become to late in the fall/winter to get going on marketing. Ah well I've given it up to the universe.

Yes the initial offer was in writing. They countered verbally, then we countered THEM verbally. Agent wants to put our counter to their verbal counter in writing. LOL! Such a game. |

I believe it is part of real estate law that nothing is considered binding in real estate unless it is in writing. When we were looking to buy a farm (a quarter century ago), we found a place and offered. The seller called and said she would take our offer and we should meet her on Monday at the lawyer's office (this was Friday). On Sunday she sold the farm to someone else. Our real estate agent said this was totally legal (if discourteous) as she had not put anything in writing about accepting our offer. |

Yeah Robin you are correct, it essentially has to be in writing in order to be binding... I think there has just been some verbal negotiations in between written offers in an attempt to get people on the same page. We signed paperwork last night for our counter to their counter so we'll see what happens. Every day Mr. FG is at his current job is downright torturous. So this farm thing needs to get wrapped up one way or another this week. If it is not going to fly he needs to find another job ASAP. We are reaching the top of what we want to pay for it, and getting to a "take it or leave it" point. |
