So I'm totally blown away. I went to argue a traffic ticket that I got about a year ago. Basically in a nutshell what happened... I came over the top of a hill behind a big SUV who had been going crazy fast, and there was a cop already there with his lights on. He pulled a u-turn and pulled ME over, for not just a little over the limit, but a LOT over the limit. I know full well I couldn't have been doing that speed since my jeep, while cute, can't accelerate that hard over a steep hill. So we go to court and... Cop claims he pulled me over a FULL THREE INTERSECTIONS NORTH. On the downward side of the hill. At which point I absolutly could have been doing the speed he claimed. But I know I wasn't that far along - I wrote down the intersection at the time. So obviously the judge beleived the cop over me, and I'm stuck with the fine and a mark on my otherwise clean driving record . To make it worse, the judge made it clear from the second I opened my mouth he didn't give a $hit what I had to say - when I asked if there was a radar print out, or anything to prove I was going that fast, I was told that the officer's word is good enough and they don't have to prove anything. Options: 1) suck it up and pay it 2) Stew about it for the full two months I have to pay it, and then suck it up and pay it 3) Appeal it (time, money, STILL my word against the cop) 4) Make a complaint to the police board, at the very least about inaccurate record keeping. The ticket is charmingly vague - no intersection noted, no actual speed noted. I'm really left feeling that the cop knew how to write a ticket that would stick, regardless of the circumstances. It's not a ton of money or points, but the lack of justice on the whole thing really grates. WWYD?? Edited by TarynJ, Feb 18 2009, 10:09 PM.

Scream and yell in the privacy of my own home...then suck it up and pay the bill. The fact that it's been so long does not bode well for you and of COURSE they're going to take the cops side over yours. Next time...ask for details to be written AT THE SCENE so you have evidence at the time of the incident. it sucks but there it is...

I would hire a lawyer and subpoena the record of the events. The officer called in the traffic stop on the radio........what was the location that he told his dispatchers? These transmissions are recorded. Subpoena the record in the Computer Aided dispatch (CAD) system. The dispatcher should have recorded in CAD the location of the traffic stop and that record is permanent even if the recordings are no longer available (many jurisdictions automatically purge radio recordings every 60 days). If your ticket was not filled out properly, with ALL pertinent information including location of stop and your estimated speed, a lawyer can certainly argue that the citation is improper and it might be thrown out. All of this requires $$ and time from you. If it's worth it to you, then do it and good luck. If not, scream and rant and rave and never trust cops again.

Im not sure about where you are, but here Im almost positive that if you ask for a radar reading, they are required to give it, as well as the little slip of paper that says the last time it was calibrated. I would make some phone calls at least. Your insurance is going to go up so you will be paying for this ticket for the next five years. I really hate when police do something so blatantly wrong. I am so sorry!! Never go to court w/o a lawyer, you will [probably] never "win" w/o one. They expect you to pay into the system one way or another. Similar situation happened to hubby - learned our lesson. Most times though, it isn't worth going to court, I just pay and move along. I am a speeder in general, so when/if I get caught when I get a bit big for my britches, it could be worse, they could catch me every day. ![]() |

Something similar happened to me. I KNOW I wasn't going as fast as he said said I had JUST PULLED OUT!!! and he had me 3 miles down the road. I just paid it. I'm kind of with Brydelle. I am a pretty regular speeder (though less so now that I've been nabbed a few times) but I figured it was karma for not getting pulled over those times when I WAS going twice as fast...

I like the attitude of Fenway and Brydelle. It's like at a horse show when you get robbed of first place. No sense in worrying about it, there's going to be another show or another class where the OTHER person should have won it. It all evens out. |

Wow, that sucks. Officer dippity donuts deserves a serious mouth washing with soap. I have never gone to fight at ticket, I have thought about it but I am not very brave about this kind of stuff. The judge should listen to both sides, it's the judge also to blame in this case. |
