I suppose international sports organisations are principally subject to the laws of the countries in which they are based, but does this allow them to disregard laws commonly agreed by that country and others? And how does the international nature of these organisations tie in with the whole concept of European, national, etc., rules, laws? No need to answer in full, anyone, by the way, but it's clear how some lawyers rub their hands over this kind of thing! |

Paging ursus who I believe has some knowledge in this area... FIFA predictably have expressed their support for UEFA, actually FIFA are probably laughing because they would have, unlike UEFA, likely ignored the Swiss court ruling even though they too are Swiss based. |

From what I understand from the link Merengue gives, there are various courts who have handed down various judgments, which are not compatible with each other. In the end, who decides who the most important of these courts is, and is its judgement accepted, or legally binding, on UEFA? A veritable legal minefield! Meanwhile, there are games going on tonight, which I'll now turn my attention to! |

No real upsets in this round of Europa League play. Tottenham again played mostly reserves but thanks to a Pavlyuchenko free kick, they beat Rubin Kazan 1-0. |

While the Swiss court proceeds with its enquiry into why UEFA are not following their order, the Court of Arbitration in Sport, the tribunal recognized by most sporting bodies as the ultimate court, will hear the dispute next month. http://sports.yahoo.com/soccer/news?slug=ap-uefa-sion And UEFA say they have drawn up contingency plans in the event Sion win in court. |

"BERNE, Oct 31 (Reuters) - Sion, kicked out of the Europa League for fielding ineligible players, have taken their case against UEFA to the European Commission, the Swiss club said on Monday. In the latest twist to an ever more complex and bitter struggle, Sion, who have defied UEFA and FIFA statutes by taking the case to a civil court, accused European soccer's governing body of "various violations of European Community law". Sion listed the violations as "unjustified restriction of competition, abuse of a dominant position, violation of the right of access to an independent and impartial judge guaranteed by article 47 of the fundamental charter of rights of the European Union and violation of the right to the free movement of workers...guaranteed by the bilateral agreements between the EU and Switzerland." Sion president Christian Constantin said: "Two Swiss courts have ruled in our favour but UEFA is not bothered about openly violating these decisions and demands that the Court of Arbitration of Sport (CAS) has the final word." The case began when Sion signed six new players in the summer despite being subject to a transfer ban imposed by FIFA after the club were ruled to have poached a player from an Egyptian club in 2008. The Swiss Football League (SFL) initially implemented the FIFA ban but backed down when the players won a civil court ruling in their favour. Sion fielded some of the players in a Europa League qualifier against Celtic but, after winning the tie, were thrown out of the tournament because UEFA ruled the players were ineligible. The Scottish club took Sion's place. However, Sion then won an injunction in another Swiss civil court ordering their reinstatement to the Europa League. UEFA has yet to comply with the order. UEFA has suggested several ways for reinstating Sion but wants the case to be settled at CAS, which has set a hearing for Nov. 24 although Sion have not said whether they will attend." |

Sounds like a real standoff is in store. Wasn't it the European commission who threw open the doors of transfers with the Bosman ruling which was something both UEFA and FIFA opposed? This doesn't seem to be as ground breaking as that but if the European commission rules in Sion's favor that could significantly weaken UEFA's enforcement power. |

Sion allege, among other things that UEFA violated European Community laws by not giving them access to an independent and impartial judge. That would mean any sports governing body would not be ale to enforce it's own laws without hiring an outside panel. That seems ridiculous to me. We can criticise UEFA, and FIFA for that matter, on many things but their legal process which now provides for a right of appeal to CAS (The Court of Arbitration in Sport) seems a good set up to me and one which frankly contrevenes Sion's argument of their denial of an indepenendent and impartial arbiter. |

I do not previously recall reading about CAS until about 3 or 4 years ago but I too think it is a good supreme arbiter of matters before any sports body. But how will they ahndle a matter such as this when a cort from a particular nation, here Switzerland, is at odds with a sport authority's ruling? Should be fascinating to see how this is determined. |

Back to the field of play, an impressive 4-0 win today for Atletico Madrid over Udinese, 2 goals from Adrian and one each from Diego and Falcao. The win moves Atletico even with Udinese atop their group. Hopefully Atleti's slump is truly over. With two matches left for all the clubs to play, already qualified are Sporting Lisbon, Anderlecht, Athletic Bilbao, Legia Warsaw, PSV Eindhoven and Twente Enschede. |

I've been impressed and surprised by how Stoke and Birmingham have done in the Europa League this season. Everyone knows Stoke are difficult to beat and a real pain to play against, but I wasn't sure they'd have the squad to compete on two fronts. But they're one of a clutch of teams on 12 points in mid-table in the PL while also having already racked up 10 points to lead their group in Europe. And not an easy group for total European novices either, as they're in with Besiktas, Dynamo Kiev and Maccabi Tel Aviv who are all very experienced at this level. Meanwhile Birmingham of course were relegated at the end of last season having previously qualified for Europe by upsetting Arsenal in the League Cup final. Most of their better players left in the summer so I suspected they'd sink without trace in Europe, but in fact they're locked in a three-way lead on 7 points with Braga and Club Brugge. Scanning down the list of Europa League results it did seem to me that Atletico Madrid's win was the standout result, especially considering Udinese's strong start to the season. Congratulations to Manzanares! |

Thanks Simon, yes I was happy with Atletico's result and the fact they now lead the group. With 2 matches remaining Atletico and Udinese have 7 points, Celtic 5 and Rennes 2 with the top two advancing to the round of 32. Atletico's 2 remaning games are away to Celtic which will be a tough one and then home to last place Rennes. Celtic away to Udinese on the final match day should be a key game too, as Atletico, Udinese and Celtic are in a good 3 way battle. |

Atletico Madrid, Braga and Metallist Kharkiv all qualified for the next round of the Europa League with wins on Wednesday. Atletico's win was at Celtic, never an easy place to play. With one match remaining it will be difficult for Celtic, Tottenham and Birmingham, who all lost tonight, to advance. |
