Rick, I'm so sorry your moving in did not go smoothly - to say the least. How could the condo have changed so drastically between your seeing it, buying it, and moving in? Watch out, Florida! Knowing you, you'll have it in top notch shape quickly, but I'm sorry you have to do so much extra work Enjoy it in good health and Merry Christmas :holiday: How do the boys like it? |

...It's been 2 months from the first time I saw it, and at that time it was a quick look around. I was familiar with the layout being that I had looked at others and was just looking to see the general condition.....it smelled funky and seemed dirty, but figured, as per contract, it would be cleaned.....besides, the whole crew was stumbling drunk and I just wanted to look and get out. I do hafta mention that we bought this place roughly $45-$50,000 less that comperable units.....so I got what I paid for, but never in my life expected it to be this bad....oh well, another project.

Since you just got in, is there any possibility you could deal with the seller's realtor and insist on a professional cleaning service coming through - seller's treat - to satisfy the contract? Might be worth a shot? Then you would feel clean...kind of. |

Rick, was there no walk thru the day of the closing???? In Maine, buyers always do a walk through, usually the hour or so before the closing, and then require the seller to escrow money to ensure any last minutes stuff gets done. Unfortunately, now that papers are signed, I don't think there is much that you can do. Always small claims court, as long as your contract stipulates the condition you were to take possession of the unit. Sorry about the mess Rick, but I am sure you are glad that it is over. |

There was no time for a Walk Thru by Terri & I, but her Dad did a Walk Thru while they were moving out and got into a heated arguement with them about them not being out in time, Terri's Dad was at the Closing Table stating there is no way they'd be out by time we finished signing (our Attorney requested that he be there to bare witness to them still occupying the unit). Thier Attorney contacted them by phone and they said "they had one more dump run and would be gone within an hour", so we continued with the closing.....we had little choice 'cause at that time, we were homeless and needed to go somewhere . I called our Attorney today to see if I can pursue reimbursement for cost, being they violated the contract of sale by not having the place "Broom Clean"....he said he'll try, but it'll be difficult. So, it looks like I got a bigger project ahead of me than planned....I just hope the funds hold out, if we're careful on how the $$$ is spent, I really feel we can whip this place into the Gem that it could be....it's just so overwhelming right now.....give me a week or two to soak it in and come up with a plan......Yes, I do plan to take before/after pictures for this one. We did hear from the couple who bought our house....they called to say "Thank You & they love the house".....yeah, rub it in

Oh Rick, I was afraid of that. Once the closing is done, you lose all your power. I am also sorry that you felt pressured to go ahead with the closing. I am shocked that no one suggested to escrow money. That would have been one of the first things done at one of our closings. Of course, title companies work more for the people than attorney's. It is a real sucky situation.

....we did make an attempt, but the sellers attorney said "his clients refused"....they knew they had us over a barrel ![]() On Edit: They sold without a Realtor, so we couldn't even tap into that. On Edit again : They did ask us to forward thier mail (Yeah, right, you know how far thats goin'), they also never turned off thier Cable Service....I will use it till it's shut off, then forward that bill and give the address to the Cable Co.

Rick, they really didn't. At a closing, the buyer has most of the power. They wanted/needed to sell as badly as you wanted/needed to buy. They woulda been screwed had you threatened to walk away from the table. TRUST me, they would have changed their mind about escrowing some money. Plus, the only reason for them not to want to escrow, would be because they had NO intention of cleaning the place. Otherwise, they would have had nothing to lose. But all a mute point now. Get the best cleaning service you can and get moving on getting making the place yours!!!!!!
