I`m quite confused now...not too long ago, wasn`t Iraq seen as a hole
of terrorists...the bad guys...an imminent threat to the US?

As usual the wrong party is being sued here. The Iraqi people did not beat or torchure the pilots, the Bathist party and Saddam Hussen did. The pilots should be suing the Bathists.

I think the Bush admin is fighting this because I am sure the Iraqi people would not understand our "deep pockets" doctrine of paying damages.

In suit, the person you did the damage to should be sued, not some associated person who just happens to have a lot of money.

I was on jury selection one time for a case where someone had been driving a company truck, and crashed into the plantif. The plantif was not suing the driver (because the driver had no money) but rather they were suing the company who employed the driver (because they did have money). The reason? "The company should have known the driver was a bad driver. and not let him drive". I don't remember why the driver was a bad driver, but it seemed questionable to me. I guess that is why they were having a trial.

If you read the article carefully, the attorneys said that they are willing to settle for pennies on the dollar. Anyway the Bush administration is heading to the supreme court over this one.
